The Duty to Consult
BRIRC was formed to assist the member Nations with building capacity for consultation.
The duty to consult is:
-
A legal obligation on the Crown
-
Triggered when the Crown is making a decision about a project, policy, or proposal that could impact the rights, culture and way of life of Indigenous peoples.
-
A requirement that must be fulfilled before the Crown makes a decision
Crown Consultation is a way of advancing and protecting Treaty rights, culture, and way of life. It is a two-way street and it must be meaningful to the Nations that are participating in it.
